Terms of Service
The agreement between you and Lumetry. Use the platform honestly, your data stays yours, and we’ll be straight about changes.
01Introduction
Welcome to Lumetry, an AI-assisted online-marketing analyzer. These Terms of Service (“Terms”) form a binding agreement between you (“User”) and Lumetry (“we”, “us”) regarding your use of our website, applications, and related services (collectively, the “Services”).
02Agreement to terms
By creating an account or accessing Lumetry’s Services, you agree to these Terms. If you do not agree, do not use our platform. We may update these Terms from time to time; the latest version will always be available at lumetry.ai/terms. Material changes will be announced by email or in-product notice at least 30 days before taking effect. Continued use after that date constitutes acceptance.
Please also read our Privacy Policy at lumetry.ai/privacy, which explains how we collect and use information.
03Accounts and eligibility
To use Lumetry you must be at least 18 years old and capable of entering into a legal contract. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization.
You are responsible for maintaining your account credentials and for activity under your account. Notify us immediately at security@lumetry.ai if you suspect unauthorized use.
04The services
Lumetry helps you connect marketing data sources, review curated dashboards, and ask questions that return evidence-backed answers, briefs, artifacts, and recommendations.
Insights are decision support, not professional, legal, or financial advice. You remain responsible for decisions you make, campaigns you run, and budgets you set with third-party platforms.
05Acceptable use
You agree not to:
- Upload or distribute malicious software (viruses, worms, etc.)
- Send spam or unsolicited promotional content through the Services without authorization
- Harass, defame, or abuse other users
- Attempt to collect other users’ data without explicit consent
- Resell, sublicense, or share access outside your organization without our permission
- Reverse engineer, scrape, or extract the Services beyond documented APIs
- Use the Services to violate law, third-party rights, or advertising-platform policies
- Misrepresent Lumetry output as independent third-party research
06Connected data sources
Connecting a third-party source (for example Google Analytics, Search Console, Google Ads, Merchant Center, Meta, Shopify, or email tools) is optional and under your control. You authorize each connection through the provider’s consent flow, you warrant that you have the right to grant that access, and you may revoke it at any time from Integrations or the provider’s settings.
Lumetry accesses connected sources with read-only scopes wherever the provider offers them and uses official APIs. Details of data handling—including Google Limited Use—are in our Privacy Policy.
Connected metrics reflect what each provider’s API returns. Providers may restate, sample, or delay data; Lumetry is not responsible for upstream inaccuracies, though we label sampled or estimated figures when we know about them.
07Purchases and subscriptions
Paid subscriptions unlock premium Lumetry features. Access levels depend on the selected plan.
Unless required by law, payments are final and non-refundable. Cancelling stops renewal; access typically remains active until the end of the current billing cycle.
Prices are listed in USD and may not include applicable taxes. Failure to renew or make payment may result in suspension or termination of premium access.
Ad spend on connected networks is between you and those networks; it does not pass through Lumetry.
08Generated content and intellectual property
We own the Services: software, models, design, and brand. You own your data. Briefs, reports, artifacts, and recommendations generated for your workspace are yours to use in connection with your business.
You grant us a limited license to process your data solely to provide and improve the Services. Feedback you send may be used to improve the product without obligation to you.
You may not copy, distribute, or resell any part of our Services except as allowed by these Terms. Generating or distributing illegal, harmful, or infringing material using the Services is prohibited.
09Data and security
Lumetry stores account and workspace information as needed to operate and improve the Services. Data handling practices are described in our Privacy Policy.
10Conduct and violations
We may suspend or terminate your access—without notice where necessary—for violating these Terms or engaging in fraudulent, abusive, or unlawful activities. Serious violations may be reported to relevant authorities.
11Limitation of liability
The Services are provided “as is” and “as available.” We make no express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Lumetry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue, arising from use of the Services. Our total liability under these Terms is capped at the amounts you paid us for the Services in the 12 months before the claim arose (or, if none, one hundred U.S. dollars).
12Termination
You can cancel at any time from Settings (or by contacting us); access continues until the end of any paid period unless we agree otherwise. On termination we delete or anonymize your data per our Privacy Policy, subject to legally required retention.
13Governing law
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts of Hamilton County, Ohio, unless applicable law requires otherwise.
